On December 18, 2015, the Department of Labor Appropriations Act, 2016, (Division H, Title I of Public Law 114-113) (Appropriations Act) was signed into law. Section 113 of the Appropriation Act prohibits the Department of Labor (DOL) from expending funds to enforce the three-fourth guarantee rule under 20 CFR 655.20. Therefore, in order to comply with the Appropriations Act, DOL cannot require the employer to advertise and offer to workers' full-time employment for a total number of work hours equal to at least three-fourths of the workdays of each 12-week period (or 6-week period if the employment covered by the job order is less than 120 days). However, the Appropriations Act did not vacate this regulatory provision, and it remains in effect, even though the Department will not use any funds to enforce it.
