UW Medicine has an outstanding opportunity for an ADA-WLAD Compliance Analyst.
The Clinical Risk Management department plans, organizes, and directs clinical risk management activities associated with the delivery of patient care services at UW Medicine and the University’s health sciences schools. These activities are carried out in active collaboration with entity leaders. The objectives of the program are to:
• Maintain an effective clinical risk management program and information systems that support, complement, and enhance quality improvement, patient safety and satisfaction, and other UW Medicine, health sciences schools and University programs and activities. • Assure that clinical risk management programs meet statutory, regulatory, and accreditation requirements. • Review contracts, legislation, and regulations as needed. • Assist Compliance and Risk Services staff, including Claim Services as requested.
The ADA-WLAD Compliance Analyst is responsible for advising entity leaders, Equity, Diversity & Inclusion Committees, and clinicians or staff to ensure compliance with state and federal laws related to discrimination associated with the delivery of patient care services and for coordinating responses to patient, care giver/support persons and visitor allegations of discrimination.
This position requires the ability to interact effectively with UW Medicine executives, clinical leaders, and healthcare professionals regarding sensitive matters involving significant financial and reputational risk to the University. The position also interacts directly with other disciplines to develop and implement strategies to resolve or mitigate events, complaints or grievances regarding allegations of discrimination. This position requires a thorough understanding of healthcare operations, discrimination law, healthcare regulations and accreditation standards as well as the ability to apply that knowledge to reduce risk. It also requires the skill necessary to direct and/or facilitate the investigation of allegations of discrimination and to negotiate resolutions to restore positive patient and family relations and reduce the risk of litigation or reputational harm to the University.
The nature of the work done by this position is highly sensitive in nature and could result in significant financial or reputational loss to the University, UW Medicine, or the health sciences schools. In addition, the lack of knowledge about or application of the relevant healthcare statutes, regulations or accreditation standards could result in adverse regulatory or accreditation actions.
POSITION RESPONSIBILITIES Develop and implement procedures to ensure the fair investigation and resolution of patient complaints, grievances and allegations of discrimination associated with the delivery of healthcare services. • Facilitate the creation of and then coordinate entity-based Allegation of Discrimination Response Teams comprised of representatives of management, patient relations, human resources and/or medical staff leaders at each UW Medicine entity to direct the investigations of patient discrimination complaints and grievances in compliance with CMS, DOH, TJC, AAAMC, ADA, WLAD, and ACA Section 1557 requirements. • Collaborate with entity Human Resources consultants or medical staff leaders as necessary to investigate each complaint, grievance or allegation of discrimination by a patient or family member that recognizes and respects the rights of patients and staff members. • Provide entity leadership with reports of confirmed allegations. • Develop and implement record management procedures. • Ensure that facility procedures are followed and external regulatory reporting occurs as required. • Provide the Equity, Diversity and Inclusion committees at the entity and UW Medicine levels with trend information and recommendations for improvement.
Develop Americans with Disability Act (ADA), Affordable Care Act (ACA) Section 1557, and Washington Law Against Discrimination (WLAD) awareness across UW Medicine and work in collaboration with and as a UW Medicine navigator for the University’s ADA Coordinator and the Disability Services Office to promote compliance with these laws and University policies. • Develop and implement an education and outreach plan in coordination with UW Medicine leaders and entity Diversity, Equity and Inclusion committees. • Serve as an ADA or WLAD resource for staff, working with relevant departments across UW Medicine as respects as the rights of patients, caregivers/support persons and visitors. • Provide consultation support services to UW Medicine clinicians and managers regarding specific requests for patient, caregiver/support person and visitor accommodations due to a disability. • Coordinate responses with entity leaders and as appropriate with the ADA Coordinator, UCIRO, and the Disability Services Office to respond to Office of Civil Rights (OCR) investigations, Disability Rights Washington (DRW), or similar regulatory or oversight bodies with respect to patient concerns about or allegations of discrimination. • Promote accessibility for the disabled through print and electronic means in compliance with University policy and guidance from UW Technology’s Accessibility Guidelines.
Provide guidance and support to the investigation and resolution of patient allegations of sexual misconduct. • Facilitate the creation of a UW Medicine approach to the investigation of patient allegations of sexual assault/abuse that recognizes and respects the rights of patients and staff members. • Coordinate Patient Allegation of Sexual Assault/Misconduct Response Teams to guide investigations of patient allegations of sexual assault in active collaboration with facility executive leaders/managers, quality improvement, patient safety, patient relations, and Human Resources and/or Medical Staff representatives. • Ensure that investigation plans comply with entity policy and are appropriately documented. • Monitor allegations and investigation outcomes and provide entity level Clinical Risk Management and Quality Committees (CRMQC) and other QI committees with recommendations for improvements. • Provide entity leadership with reports of confirmed allegations.
MINIMUM REQUIREMENTS • Bachelor’s Degree in Health Care or Business-related field. • Minimum of six to eight years’ experience in related field.
Additional requirements: • Demonstrated ability to work independently, prioritize and organize work in a fast-pace environment. • Ability to exercise independent judgment, decision-making, and problem-solving skills. • Proficiency in Microsoft Office (e.g., Word, Excel, PowerPoint, Office 365). • Proven ability to work effectively in a team environment.
Equivalent education and/or experience may substitute for minimum requirements. DESIRED REQUIREMENTS • Juris Doctor with experience representing clients or institutions in discrimination matters. • Experience investigating complaints of ADA, ACA Section 1557 or WLAD violations.
