As a Senior Legal Counsel this individual regularly collaborates on legal, compliance and business matters with a variety of functional teams including, but not limited to, Sales, Marketing, Market Access, QA/RA, Supply Chain, Engineering, and Operations. Additionally, this role supports Kestra’s overall strategic goals as well as those of the Legal Team. On a daily basis, this position works closely with the functional business leaders to providing proactive and strategic legal and compliance advice and problem-solving when issues arise. This position is accountable for negotiating and occasionally drafting, a wide variety of agreements and contracts in the area of Durable Medical Equipment (DME) healthcare, external partnership agreements and drafting policies that meet Kestra’s needs, protect the company, and are legally compliant. This position includes many compliance duties including, but not limited to, investigations, creating and delivering legal and compliance training, and reviewing and approving company policies and marketing collateral. This position reports directly to the General Counsel/CAO and is part of the Kestra Leadership Team.

Requirements

ESSENTIAL DUTIES

· Act as a strategic partner with Kestra Team Members and outside counsel on matters of importance to the Company by providing thoughtful, creative, and timely legal advice.

· Provide guidance and training and legal support to the overall team in support of legal department’s goals.

· Draft and negotiate a variety of agreements, including healthcare contracts with insurers, vendors, and suppliers in furtherance of Kestra as a DME provider.

· Prepare and update contract templates that seek to meet business needs, protect the company, and comply with applicable laws.

· Assist in the development of standard processes, policies, training, and strategies.

· Analyze the impact of federal and state health care laws and regulations on the clinical, strategic and business operations of a DME provider.

· Deliver practical, business-oriented advice with a focus on meeting the company’s goals in a legally compliant manner.

· Advising on all legal related employment matters including grievances, terminations, on-boarding, commission plans and other HR related matters.

QUALIFICATIONS

Education/Experience Required:

· Law degree (J.D. or equivalent) and bar admission required with a minimum of three years of relevant legal experience.

· Significant experience drafting and negotiating a broad range of contracts, including contracts with health plans.

· Knowledge of federal and state health care laws including, but not limited to HIPAA, Medicare, Medicaid and Stark laws.

· Ability to handle complex legal matters with minimal oversight while escalating significant issues in a timely fashion.

· Sound judgement, a high degree of professionalism, and an ability to prioritize and adhere to deadlines.

· Communicates clearly, concisely and persuasively with a variety of internal stakeholders (corporate business partners, team members, functional colleagues, etc.), works collaboratively and builds effective partnerships.

Preferred:

· Prior experience partnering with sales and marketing teams.

· Prior experience advising health care providers.

· Some employment law experience.

Work Environent

· Indoor open office environment

· Minimal noise volume typical to an office environment

· Extended/overtime hours when needed

· Occasional domestic travel may be required, up to 10%

Salary: Annualized between $190,000 to $220,000 Depending on experience and location.
